Fishtank Platform Terms of Use

1. Introduction

These Terms and Conditions govern access to and use of the Fishtank platform (“Platform”), operated by Fishtank (Pty) Ltd (“Fishtank”, “we”, “us”, or “our”).

By registering or using the Platform, you agree to be bound by these Terms.

2. Nature of the Platform

Fishtank is a technology marketplace that:

  • Enables experts, consultants, and professionals (“Experts”) to create profiles
  • Allows users (“Clients”) to book and pay for advisory sessions
  • Facilitates payments between Clients and Experts

Fishtank is not the direct provider of advisory services. Experts are independent contractors and are solely responsible for the services they provide.

3. Eligibility

Users must:

  • Be at least 18 years old
  • Provide accurate registration information
  • Use the platform for lawful purposes only

4. Accounts

Users are responsible for:

  • Maintaining confidentiality of login details
  • All activity under their account
  • Ensuring profile information is accurate

Fishtank reserves the right to suspend or terminate accounts that violate these Terms.

5. Payments & Fees

  • All bookings must be paid in advance via the platform.
  • Fishtank may deduct a platform commission before remitting payment to Experts.
  • Experts are responsible for their own tax obligations, including VAT where applicable.

6. No Guarantee of Outcomes

Fishtank does not guarantee:

  • The accuracy of advice
  • Business outcomes
  • Financial results
  • Performance improvements

All advisory services are provided at the Client’s own discretion and risk.

7. Cancellations & Refunds

Refunds and rescheduling are governed by the Fishtank Refund Policy.

8. Intellectual Property

All platform content, branding, and software remain the property of Fishtank.

Experts retain ownership of their own content uploaded to the platform but grant Fishtank a license to display and promote their profiles.

9. Limitation of Liability

To the maximum extent permitted by law:

Fishtank shall not be liable for:

  • Indirect or consequential damages
  • Business losses
  • Loss of profits
  • Disputes between Clients and Experts

10. Dispute Resolution

Disputes between Clients and Experts should first be resolved directly.

Fishtank may assist at its discretion but is not obligated to mediate disputes.

11. Termination

We reserve the right to:

  • Suspend accounts
  • Remove content
  • Terminate access for violations

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
